How to Use NY Maintenance & Child Support Calculator
The NY Maintenance & Child Support Calculator helps estimate two related New York family law figures: guideline maintenance and basic child support. Enter the annual income for each party, then add annual deductions that should be excluded from the simplified income base. Add the number of children, choose whether to calculate maintenance, and choose whether to apply the CSSA income cap.
If you want the tool to estimate maintenance, keep the guideline method selected. If you already have a proposed annual maintenance amount, switch to the manual method and enter that amount. The NY Maintenance & Child Support Calculator then adjusts the parents’ incomes for maintenance before estimating basic child support, income shares, annual support, and monthly support.
Formula & Theory - NY Maintenance & Child Support Calculator
The NY Maintenance & Child Support Calculator uses simplified versions of the statutory concepts:
Guideline maintenance ≈ min(20% of payor income - 25% of recipient income,
40% of combined income - recipient income)
Combined parental income = adjusted payor income + adjusted recipient income
CSSA basic child support = CSSA income used × child percentage
Non-custodial obligation = CSSA basic child support × non-custodial income share
The child percentages used are 17% for one child, 25% for two children, 29% for three children, 31% for four children, and at least 35% for five or more children. The calculator also provides a rough maintenance duration range based on marriage length bands.
Assumptions and Limits
This calculator is intentionally simplified. It does not adjudicate imputed income, add-on expenses, health insurance premiums, childcare, education costs, tax filing status, credits, self-employment adjustments, or deviations. New York courts may also apply caps differently and can order amounts above or below guideline results.
